Hospital Negligence and Hospital Infections

Though cases of hospital negligence and malpractice are not as common as other types of medical malpractice, hospitals have a responsibility to both their staff and their patients to provide the best quality and standards of care, as well as a safe and hygienic environment.

Hospitals are required to have several policies and protocols in place, one of which being the hospital’s stance and procedure related to infection control. It is the duty of the hospital to not only establish these protocols but to monitor them consistently to ensure that they are being adhered to. Not doing so can lead to patient injury or even death.

It was reported that an estimated 1.7 million cases of hospital-acquired infections occurred in the United States in 20

16. Sadly, almost 100,000 of these resulted in death. Additionally, the CDC estimates that every 1 in 20 hospitalized patients develops some type of hospital infection.

Common Types of Infection

Known as healthcare-associated infections or healthcare-acquired infections, hospital infections occur as a result of healthcare professionals and other staff not following infection control procedures. Some of the most common types of infection that result from poor infection control include:

  • Catheter-assisted urinary tract infections: which occur when a catheter has been left in a patient for too long
  • Pneumonia caused by ventilators: which occurs 48 hours or more after mechanical ventilation is given and not appropriately monitored
  • Necrotizing fasciitis: which occurs when a serious bacterial infection spreads and kills your body’s soft tissue
  • Clostridium difficle: which occurs when the bacteria in your digestive tract overgrow and release toxins that attack the lining of your intestines if you have not been monitored appropriately as an in-patient
  • Carbapenem-resistant Enterobacteriaceae: which occurs when a duodenoscope has been improperly used and has resulted in germs that are highly resistant to antibiotics entering your body
  • Meningitis: which occurs when you have not been monitored appropriately and can spread due to the use of contaminated instruments or drugs
  • Methicillin-resistant staphylococcus aureus: which occurs when the bacteria that live in your nose and skin enter the surgical sites on your body due to poor infection control and become invasive
  • Sepsis: which occurs when you have not been appropriately monitored or treated with contaminated instruments and drugs. It is a deadly blood infection that triggers inflammation throughout your body

Legal Matters

Because hospital negligence lawsuits are not as common as other types of medical malpractice lawsuits, it is crucial that you consult with a qualified medical malpractice lawyer when you wish to sue a hospital. There is a complex body of rules that regulate medical malpractice law, and these differ between states. You will need a qualified NYC medical malpractice attorney familiar with the laws of NYC to help you.

Your lawyer will explain to you that there are several terms and conditions that need to be met before your case can be brought to trial and to ensure that your case is viable. You will need to be able to prove that improper conduct on the part of the hospital employees and/or hospital administration occurred and that this misconduct caused you or a family member harm.
