This action settled for $1.26 Million Dollars during jury selection. Plaintiff a 30 year-old teacher's aide, was heading towards Queens on the Throgs Neck bridge when their vehicle became disabled. She moved to the right lane and got out of her vehicle in an attempt to flag down a motorist to help. Defendants van, which was traveling in the same direction in that lane, struck the stalled vehicle at approximately 40 mph. Defendants contention was that he was attempting to change lanes when he was forced over into the right lane by a passing truck.
