The case involves a 67-year-old female who presented to a Bronxville Hospital in 2007 after a fall and underwent MRI which revealed a T-5 fracture of undetermined age. She developed seizures from a medication administered in the hospital, underwent a further MRI which now showed a collapsed T-5 fracture. Despite her request for conservative treatment, she was rushed into surgery, absent the knowledge of the increased risk due to her specific type of fracture. During the kyphoplasty procedure, cement extravasated (leaked) into the spinal canal and ultimately ”cooked” the spinal cord, resulting in the patient‘s becoming hopelessly paraplegic. The nursing staff thereafter failed to properly assess her fall risk, resulting in a fall causing additional life-altering injury. Our medical experts were able to connect her injuries to the surgical errors, extravasation of the cement, and negligent monitoring of the nursing staff.
