The case involves improper and prolonged administration of Cervadil and Pitocin to a young mother, without progression of labor, causing over-stimulation to the fetus. Despite the mother’s development of an infection, chorioamnionitis, fever, unstable vital signs, and nonreassuring fetal monitoring strips which revealed severe, persistent variable decelerations, she was allowed to continue to labor and no plan was considered regarding cesarean section. Our experts were able to demonstrate that the failure to timely perform cesarean section allowed strain on the infant, resulting in brain damage, seizure disorder, developmental delays, cerebral palsy, right spastic hemiparesis, as well as significant secondary microcephaly which have had a profound impact on the future growth and development of this child.
