Jefferson Airplane Singer Disabled by Mount Sinai Beth Israel Hospital

By Rosenberg, Minc, Falkoff & Wolff, LLP. posted in Hospital Negligence on Tuesday, November 19, 2019.

In March of 2016, the then lead singer of Jefferson Airplane, Marty Balin, was rushed to the emergency room at Mount Sinai Beth Israel Hospital due to complaints of severe chest pain. What followed was a nightmare far beyond what he could have imagined.

Doctors performed open-heart surgery, which included a triple bypass and a valve replacement that forced Balin into the intensive-care unit (ICU) for recovery – the one place in any hospital that requires the most specialized and supervised care. What doctors had failed to tell him upon admission was that the hospital was in the process of closing, and they were severely understaffed.

Due to the nurses’ negligence, Balin’s condition deteriorated rapidly, and he had to undergo a tracheotomy, which is a highly invasive windpipe procedure to assist you when you cannot breathe. Unfortunately, this procedure was scheduled too late, and Balin was improperly intubated for a prolonged period, which caused pressure on his tongue, and a buildup of blood at the tracheotomy site. These doctor errors resulted in one of Balin’s vocal cords becoming permanently paralyzed, and half of his tongue had to be removed due to necrosis – a tragedy for someone who makes their livelihood through singing. Worse, Balin’s IV was not properly placed or monitored while he was in recovery, and he suffered a necrotic infection that required his left thumb to be amputated. Additionally, he also suffered from bedsores and kidney damage and was unable to eat, sleep, or speak properly after discharge.

Balin’s life changed as a result of this medical malpractice. He was forced to undergo dialysis for the rest of his life and could no longer care for his special-needs daughter. He was unable to sing and could no longer play the guitar, which is why he filed a medical malpractice lawsuit and sought financial compensation. Sadly, Balin died two years later at the age of 76, and the cause of his death has not been disclosed.

Legal Matters

Marty Balin’s medical malpractice lawsuit is quite a complicated one, as it involves instances of doctor errors, nursing negligence, and hospital negligence:

        Doctor Errors

Doctor errors are a type of medical malpractice that results in you suffering an injury or harm at the hands of your doctor. This injury is preventable and would not have occurred had your doctor not been negligent, as seen in Balin’s case where the doctor who performed his tracheotomy scheduled the procedure too late, improperly intubated him for a prolonged period and did not monitor him correctly throughout the procedure. Had he not made these errors, Balin would never have suffered a paralyzed vocal cord or lost half of his tongue.

        Nursing Negligence

Nursing negligence is a type of medical malpractice that occurs when a nurse does not care for you in an acceptable way that has been established as the standard of care of the profession. This results in injury or harm to you and is seen in Balin’s case, where he had his IV inserted incorrectly and was not monitored appropriately. The amputation of his left thumb, his bedsores, and his failing kidneys all could have been avoided had the nurses taken better care of him.

        Hospital Negligence

Hospital negligence is a type of medical malpractice that occurs due to improper conduct on the part of hospital administration and/or hospital employees, which results in physical injury or harm. Sinai Beth Israel Hospital acted extremely negligently by not transferring Balin to another hospital for after-care once his heart surgery was complete, and most, if not all, of his post-operative injuries could have been avoided had they done this.
